How much will I make?

Mwendo’s ethos remains Pay for Performance. Mwendo relies upon Broker Affiliates to promote and advertise the service locally. Since you receive a percentage of revenue from within a given state or MLS territory, your compensation corresponds to your success in effectively marketing the service to fellow real estate agents and the general public.

The current percentage structure is as such:

  • Master Broker Affiliates receive 3.5% of net income derived from rewards offered by real estate professionals from the entire state.
  • Primary Regional Broker Affiliates receive 3% of net income derived from rewards offered by real estate professionals from that MLS territory.
  • Associate Regional Broker Affiliates receive 2% of net income derived from rewards offered by real estate professionals from that MLS territory.

How much will it cost?

Broker Affiliates are required to cover the costs of MLS membership and access and/or state real estate licensing fees. At your discretion, any marketing or advertising conducted to promote the service must also be covered. Regional Broker Affilates may be responsible for paying a $375 RETS/IDX integration fee. How should I advertise?

That decision is left entirely up to you. Some suggestions for marketing to fellow real estate professionals include advertising in MLS association newsletters or trade magazines. When promoting to the general public consider placing advertisements in newspapers, magazines, and local websites. A no-cost solution includes simply placing “Visit Mwendo.com” in your existing and planned marketing materials.

Don't rebates to homebuyers violate the Real Estate Settlement Procedures Act (RESPA)?

No, RESPA does not prohibit rebates to homebuyers. RESPA prohibits kickbacks among service providers that inflate the cost of housing to the consumer. For more information on RESPA, visit HUD or Wikipedia on the matter.

In fact, the US Department of Justice (DOJ) actually encourages rebates as it fosters competition among real estate professionals and makes housing prices more affordable. The DOJ has actually created a website outlining its support of rebates and its efforts to prevent state legislatures from banning them. For more information, click here.

Are rebates prohibited within my state?

Possibly. Currently, twelve states currently ban rebates and/or inducements to homebuyers. These states include:

  • Alabama
  • Alaska
  • Kansas
  • Louisiana
  • Mississippi
  • Missouri
  • Montana
  • New Jersey
  • North Dakota
  • Oklahoma
  • Oregon
  • Tennessee

Additionally, Iowa prohibits rebates when consumers use the services of two or more real estate brokers during a transaction.

As such, in these states, Mwendo intends to postpone offering its reward program and is not currently offering its Broker Affilate program.

The US Department of Justice (DOJ) encourages you to petition your state government to repeal these anti-competitive laws. The DOJ successfully fought for the repeal of such prohibitions in Kentucky, South Dakota, and West Virginia.

Will my MLS association let Mwendo access its listings?

Yes, most likely. Though you will need carefully review your MLS association's terms and conditions for accessing its listing data. Many MLS associations have adopted anti-competive measures. The DOJ is actively pursing MLS associations which unfairly prohibit brokers from display listing data. For more information of the DOJ's efforts on this matter, click here.
